DHSS Application: 144 Questions to Go

With only 109 days to go before August 3rd, draft rules are giving potential dispensary owners, cultivators, and infused product manufacturers insights into WHAT TO EXPECT on Missouri's medical marijuana applications.



10 TOPICS: 144 QUESTIONS DRAFT RULES


The draft rules provided by the DHSS have divided the application questionnaire into 10 distinct topics.


  • Each topic and question will be given a scoring weight

  • Weights have yet to be assigned

  • "Evaluation Criteria Scoring Table"

  • Scores will vary from "unsatisfactory," "satisfactory," "superior" or "distinctive"

  • 20 public members will hold hearings to discuss April 17th-May 1st

  • bout seven weeks to finish up the rules.

  • Applications beginning Aug. 3

  • A third party will score them

WHAT TO EXPECT ON THE APPLICATION DRAFT RULES


The application will be divided into 10 sections. Each question will be scored and combined with the applicants business plan, financial statements, attestations and local authority approvals along with a copy local licensing rules on time, place and manner.

WHAT ABOUT LIQUID ASSETS DRAFT RULES


Amounts proposed so far are at least:

  • $500,000 for cultivation applicants

  • $300,000 for dispensary and manufacturing applicants

  • $200,000 for testing facility applicants

  • $150,000 for transportation applicants

Our opinion: the liquid assets question is NOT in the language of the Amendment. It is our belief that requiring liquid assets in combination will the cost of the non refundable application fees is an abuse, creates an undue burden on applicants and was NOT the intention of Missouri voters.

PRINCIPLE OFFICERS, MANAGERS, AND CHARACTER DRAFT QUESTIONS


  • All key "principal officers" or "managers"

  • A letter of recommendation for applicant's "character"

  • Another letter of recommendation for applicant's "veracity," or truthfulness

  • A resume or CV and other career documentation, including information as to whether applicants have run a business for five years or longer.

  • Applicants will be questioned in detail about whether they owe any taxes,

  • Any government actions related to applicant's professional life

  • Or marijuana regulations in other states

  • Any owner or manager is a convicted felon must document

  • Any trouble with the DEA or a state-level drug regulator must document
